US Judge Orders Freedom of Abrego Garcia from Immigration Custody
A federal judge has ordered the prompt release of Kilmar Abrego Garcia from detention by ICE, finding his ongoing confinement is without legal authority.
"Since his release after erroneous imprisonment in El Salvador, he has been taken back into custody, again without legal justification," the judge stated in her order.
The case stems from a mistaken deportation to El Salvador in March, which US authorities later admitted was an mistake. After his repatriation to the United States to answer human smuggling allegations, he was held in federal detention.
In her decision, the court pointed out that the authorities does not have a valid removal order, which prevents them from removing Mr. Abrego Garcia "at this time."
Context of the Legal Challenge
The court challenge center on conflicting assertions. While the former administration argues that Abrego Garcia is a member of the MS-13 criminal organization, he vehemently denies this claim.
He has also entered a not guilty plea to the smuggling charges, which are part of a ongoing criminal case in Tennessee.
Terms of Freedom
The court, who was overseeing his petition to deportation in a Maryland district court, ruled that he must now comply with the terms of his release from custody in Tennessee. This decision shifts his monitoring to the Tennessee court.
This ruling marks a significant development in a complex immigration battle involving allegations of wrongful detention and contested gang affiliations.
